XForge Smartphone Pre-Order Terms and Conditions
1. Main Terms
By placing a pre-order for the XForge Smartphone (the "Phone") through https://xprotocol.org/xforge or any other affiliated website (the “Website”), you agree to these Pre-Order Terms and Conditions ("Terms"). Please read them carefully before making a pre-order through our website. These Terms govern the pre-order process for the XForge Smartphone. By placing a pre-order, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
2. Pre-Order Process
By pre-ordering the Phone, you are requesting at no charge an option to purchase the Phone once it becomes available. Pre-ordering does not guarantee availability in all regions, and certain areas may be excluded from delivery based on logistical and regulatory limitations. We will notify you if we are unable to fulfill your pre-order due to these or any other constraints. We may cancel the pre-order at any time for any reason with or without notice in our sole discretion.
3. Non-Final Specifications and Design
Please note that all product descriptions, including but not limited to specifications, designs, colors, and packaging, are subject to change. The final product may differ from any images, specifications, or other information provided at the time of pre-order. We reserve the right to make changes to the Phone prior to shipment without prior notice to you.
4. Reservation and Payment
Upon placing a pre-order, you will be required to provide certain information to enable us to process the request. A pre-order payment or payment information may be required at a later stage in order for you to be eligible for the shipment. By submitting payment information, you authorise us to charge your provided payment method regardless of when the Phone is available for shipping.
5. Pricing
The purchase price of the XForge Smartphone provided at the time of pre-order is not final and is subject to change. We reserve the right to adjust the price at any time before the Phone is shipped. If the price is adjusted, you will be notified, and you will have the option to either accept the new price or cancel your pre-order.
6. Delivery and Availability
The estimated shipping date for the Phone is provided at the time of pre-order and is subject to change. The delivery of the Phone is contingent upon factors beyond our control, including manufacturing schedules, customs clearances, and logistical limitations. The Phone may not be available in certain areas, and we are not responsible for delays or the inability to fulfill orders in specific regions.
7. Limitation of Liability
To the fullest extent permitted by law, the company will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of data, or damages arising from your use of or inability to use the Phone, even if we have been advised of the possibility of such damages. Our total liability under these Terms shall in no event exceed the amount paid by you for the pre-order.
8. Warranty and Product Liability
All warranty and product liability obligations related to the XForge Smartphone rest solely with the phone manufacturer. The company does not provide any warranty, express or implied, for the Phone and is not responsible for any manufacturing defects, malfunctions, or performance issues. Any claims regarding the warranty or product defects must be made directly to the manufacturer in accordance with their warranty policies.
9. Cancellation and Refunds
You may cancel your pre-order at any time before the Phone is shipped, and you will receive a full refund of any amounts paid. Once the Phone has been shipped, all sales are final, and any returns or exchanges must be handled in accordance with the manufacturer’s return policy.
10. Further use of the Phone
Subject to you successfully completing all pre-order requirements and accepting delivery of the Phone, you will be bound by the XForge terms and conditions, and/or any other related terms that will govern your use of the Phone, along with any software pre-installed on the Phone. In case you wish not to be bound by any such terms, we may not be able to provide any refunds or accept the Phone back. Your only recourse may be to stop using the Phone.
11. Changes to Terms
We reserve the right to make changes to these Terms at any time. Any changes will be posted on our website, and continued participation in the pre-order process after such changes will constitute your acceptance of the new Terms.
